A former police officer was spared by prison because of his fatal tasser solution, a 95-year-old woman with symptoms of dementia at a home for the care of the elderly in Australia.
Christian White said he used the weapon to prevent a “violent confrontation” after discovering a disoriented Claire Knowland and holding a small kitchen knife in May 2023.
But the officer was found guilty of murder With the jurors last November, after prosecutors argued his actions to great-grandmother, which later died of their injuries were “grossly disproportionate.”
The case caused a public protest, with the judge at one point saying that “unlike anyone else I had to stand up with” for nearly two decades on the bench.
Following his sentence to the Supreme Court of New South Wales (NSW) on Friday, justice Ian Harrison said White’s actions at Yallambee Lodge in the city of Kuma near Canberra are a “terrible mistake”.
The “obvious” reality was that Mrs. Knowland was a “fragile and confused 95-year-old woman” who “is nothing that could reasonably be described as a threat of any substance.”
“The simple, but tragic fact seems to me that G -n -White is completely – and in an existence of an inexplicable view – I mistakenly read and misunderstood the dynamics of the situation,” said Harrison.
The process that heard White was called to the care home around 4:00 on May 17, 2023, after G -Naland was seen to intensify around the premises with two serrated knives on the steak.
The bodysuit of the body chamber showed that he warned Da, Knowland to release the blades while heading for his weapon to it before saying “bug forests” and fired. She fell and hit her head, triggering fatal brain bleeding.
The defense pointed out evidence from one of the Fields and the White police partner, which they both stated that Da -Knowland made them feel scared of their safety.
But prosecutors claimed that Da Noland – who weighed under 48 kg (105 pounds) and used a walker to get around – did not pose a threat and the officer was “impatient” using his weapon only three minutes after colliding with it.
The family of G -Ja Nowland, during the hearing of the sentence last month, said that the “unattainable” and “inhuman” actions of White had changed their lives.
“To this day, I have been injured by this dispassionate fear of fear,” said Michael Knowland, Claire’s most big son before the court.
He described his mother as “the most concerned person in the world” and said the family wanted justice.
Earlier, White told the court that he did not think that G -Nowland would be “significantly wounded” and that he was “devastated” by her death.
In an apology letter to her relatives, White wrote: “I am deeply sorry for my actions and the serious consequences they have caused, not only to Mrs. Knowland, but also to your family and the greater community.”
White had served as a police officer at NSW police for 12 years before being removed after his sentence.
Justice Harrison said the prison period is not necessary, given that White has already lost his job and has become an unwanted member of the local community and does not pose a risk of re -reinstalling. He added that it would be difficult for a former officer to live in prison.
He condemned White to a community correction order for two years – essentially a good connection with behavior – and 425 hours of public service.
The death of D -Ja Nowland has sparked global outrage and controls the use of Police force in NSW.
Commissioner Karen Webb described death as a “terrible tragedy” that should not happen, but stressed that the policies of power and training were appropriate.
