Airlines Delta and UNITED Claim for Sale of Window Seats Without Windows

Delta Air Lines and United Airlines are sued by passengers who claim to have been charged extra for the window seat but found themselves sitting next to an empty wall.

Judicial cases, filed separately against US carriers, are looking for millions of dollars for more than a million customers from each airline.

They said that companies did not mark that the seats were without windows during the reservation process, even when they load a premium for them.

United declined to comment as it is a continuing legal issue. BBC contacted Delta for comment.

The court cases, which are formulated in a similar manner, are looking for the refund of additional fees for passengers who have said they paid for the windows but have received no windows instead.

Both lawsuits seen by the BBC were filed by the legal company Greenbaum olbrantz.

Complaints say some Boeing and Airbus aircraft have places that do not have windows due to the positioning of air -conditioning channels, wiring or other components.

These places are not marked by Delta and United during the booking process, according to court documents.

Judicial cases say that people buy windows for various reasons, including to deal with fear of flying and movement, to keep children busy or for the view.

Some passengers would not choose these places – or paid more for them – if they knew they had no windows, according to complaints.

Both airlines describe each seat on the sides of their planes as a “window seat”, even when they know that some are not up to the window, the documents say.

Passengers can be charged more to choose a window seat compared to a standard seat.

The lawyers representing each case described the practice as “fraudulent” and “illegal”.

Other carriers, such as American Airlines and Alaska Airlines, work with similar aircraft but reveal during the booking process if the seat does not turn on a window, they added.
