The 72-year-old retired grandmother had been unconscious by her then-husband Dominic for more than a decade and raped by dozens of men he had been recruiting on the Internet.
The 44 -year -old Husametin Dogan claims to be innocent, despite the graphic video footage shown in the vessel penetrating the stationary Gisèle Pelicot.
But the Nîmes Court of Appeal rejected his argument and extended its original nine -year prison to 10 years. He was convicted of aggravated rape last December, during a trial, in which 50 other men were sentenced.
Prosecutors asked the court to impose a 12-year term on Dogan, who said he was a victim himself “caught” by Dominic Pelicot.
Although Dogan spent time in pre -trial detention before last year, he has not spent time in prison ever since.
Police were able to follow the men who raped Gisèle because of the videos Dominic Pelicot filmed during the rape.
Of the 51 men who handed over the prison, 17 initially filed appeals only to withdraw them shortly after.
Husametin Dogan – a married father born of the Turks – was the only one who decided to take his complaint before the court.
Guillaume Horcajuelo/EPA/ShutterstockLike many other men condemned last December, Dogan’s defense was that he could not be guilty of raping Giselle, as he did not realize that she had been drugged by her husband against her will.
Production in Nîmes was an effective consideration, but unlike the original process last December, this case was evaluated by the jurors made up of nine public members and three professional judges.
The evidence of the first test was shown again, including videos of rapes in which an unconscious gisele could be heard and had no reaction, despite the abuse it was subjected to.
Nevertheless, Dogan again denied any intention to rape her, although he admitted that she was obviously the victim of her husband.
“I did a sexual act, I never raped anyone,” he said. “For me, rape means to force someone, to bind them, I don’t know … I’m a victim.”
Giselle Pelicot told the court this week, “I am the only victim”, denying that she had ever given her consent.
In an attempt to transfer the blame to Dominic Pelicot, Dogan also said that while at one point he had “suspicions” that something about the situation was not quite correct, Pelicot calmed him down. “This man is a manipulator,” he said.
Pelicot – who is present in court as a witness – denied that he had ever pretended that his wife would be anything but unconscious.
All the men he is recruiting in a chat rooms “was said to be drugged,” Pelicot said, adding that he had explicitly told Dogan that he was looking for “someone to abuse my sleeping wife without her knowledge.”
