Donald Trump has been ordered to stand trial on January 10th in New York on a “hush money” charge, just days before his second term in the White House.
Judge Juan Mercan rejected Trump’s argument that the U.S. Supreme Court has recognized broad immunity for presidents to carry out their official duties, rejecting the criminal charges.
Mercan wrote on Friday that Trump’s sentencing should take place before his inauguration on January 20.
However, he said he had no intention of arresting the president-elect. He was charged last year He was indicted in New York state court on 34 counts of falsifying business records, which prosecutors said was a ploy to buy the silence of a porn star he had ties to.
“While this court is not required to issue a sentence before giving the litigants and the defendants a chance to be heard, at this time it seems appropriate to announce the court’s inclination not to impose any prison sentence, as a sentence that is permissible but accepted by the public does not seem to me to be a practical recommendation,” Mercan wrote.
