A federal judge said a two-year-old US citizen may have been deported to Honduras with his mother and 11-year-old sister without a proper process, against the backdrop of the Trump administration to increase deportations.

In the court filing, Judge Terry Dowti said there was a “strong suspicion” that the child – identified only as VML – was deported “without a meaningful process”.

The child born by Louisiana and her family members were detained during a routine meeting at the New Orleans Immigration Service on April 22, according to the document.

A spokesman for the US Department of Interior Security said the mother wanted to take her children with her when he was sent to Honduras.

The judge tried to arrange a phone call with the girl’s mother, but it was said by the government lawyer that “it won’t be possible, since she (and probably VML) has just been released in Honduras,” the court documents said.

The mother’s immigration status, the girl’s father and sister remains unclear. However, the two -year -old is a US citizen.

“It is illegal and unconstitutional to deport, to detain to deportation, or to recommend deportation to a US citizen,” the judge said.

Hearing is scheduled for May 19, “in the interest of distracting our strong suspicion that the government has just deported a US citizen without a meaningful process.”

The Secretary of the Ministry of Interior Security, Trisha McLaughlin, said in a statement to the US partner of the BBC, CBS News, that “the parent has decided to bring the child with him to Honduras.”

She added: “It is customary for parents to want to be removed with their children.”

Earlier this week, the girl’s father had also applied for a temporary transfer of a legal authority, who, according to state legislation, would have given his daughter -in -law – also an American citizen – arrest of children.

The ICE and Customs Affairs Agent (ICE) spoke to a family lawyer and “refused to honor the request” and said that “the father may try to take it, but he will also be removed.”

In a second, a similar case in Florida, a Cuban woman with a one-year-old child and her husband of US citizens were detained at a planned immigration meeting and flew in Cuba two days later, according to media reports.

The woman identified as Heidi Sanchez is still breastfeeding her daughter, who suffers from seizures, according to her lawyer. He claims that Dj Sanchez was not a criminal and had to remain in the United States for humanitarian reasons.

Thousands of undocumented immigrants have been detained since Donald Trump returned to the White House on January 20.

Trump’s hard immigration policies have met a number of legal obstacles.

In the highest-ranking case, the government acknowledged that it was wrongly deported by El Salvador’s national Kilmar Garcia, but claims to be a member of the MS-13 gang, which denies his lawyer and family. D -N -Abrego Garcia has never been convicted of a crime.

The Supreme Court unanimously ruled that the government should Facilitates the return of the abrego garciaBut the Trump administration said “will never live in the United States again.
