Eric Menendes has been diagnosed with a “serious medical condition,” his lawyer told numerous US news publications.
The news is coming weeks before he and his brother Lyle go to a finding of conditional release after spending decades in prison for the killings of their parents.
The lawyer did not provide more details about the medical condition. The BBC asked for a comment.
Menendes was taken from a prison in San Diego, in which he was detained by an external medical facility on Friday.
The State Department of Correction and Rehabilitation in California told the local exit CBS 8 that Mendes is in a “fair state”, but that it cannot give further details.
The brothers behind bars for 35 years have been outraged in May to 50 years in prison for the Kitty and Jose Menendes killings in 1989.
Previously, they serve life without the possibility of conditional release.
But earlier this year a judge in Los Angeles appointed 54 -year -old Eric, and the 57 -year -old Lyle does not pose a “unjustified risk” if they are released. The judge added that the brothers had “done enough” while in prison to deserve a sentence change.
The couple’s new sentence made them eligible for release from their young age when their crimes were committed.
The brothers’ lawyer Mark Geragos called for the release of Eric Menendes in an interview with TMZ, citing his client’s health.
“I just think he has to be released from conditional release. I think it is the right term and it can be enveloped before hearing so that he can work with the conditional release lawyer and get up and be ready and to do it and give him his best shot,” said G -n -n -n. “I think this is the only just and just thing.”
The hearing of the brothers’ release is scheduled for August 21.
The couple went through two trials before being convicted in the 1990s. They claim that the killings were self -defense. Prosecutors claim that the brothers are spoiled young men who killed their parents for financial profit.
