A federal judge in California has ruled that the deployment of President Donald Trump’s National Guard in Los Angeles is illegal this summer.
The decision comes when Trump seeks to use the National Guard troops to cope with crime in other cities in the United States and to support the implementation of immigration.
Trump unfolded the troops of the National Guard in Los Angeles in June in response to protests against immigration attacks.
US District Judge Charles Brayer ruled on Tuesday that the government had violated the Posse Comitatus Act, which restricts the federal government’s power to use military force for internal issues.
Judge Bray has made the decision by September 12 and Trump is likely to appeal.
The president has already deployed hundreds of troops at the National Guard in Washington and weighs the sending troops to Chicago immediately after this week.
After Trump deployed troops in Los Angeles, governor Gavin Newo sues the administration for suspected violations of the Posse Comitatus Act.
Judge Breire’s order is applied only in California, but may signal legal challenges to Trump’s plans to use security to implement his policies.
“The latest executive orders of President Trump and public statements about the National Guard have been raising serious concerns as to whether he intends to order the troops to violate the Posse Comitatus law elsewhere in California,” Judge Bray writes.
He warned that Trump and Defense Minister Pete Heget risk “set up a national police force with the president as his own chief.”
He blocks the National Guard to implement the following laws, including “participation in arrests, concerns, searches, seizures, security patrols, traffic control, crowd control, riot control, gathering evidence, questioning or acting as informants.”
The White House, the Ministry of Defense and the Ministry of Justice did not immediately respond to a request for comment.
This is the second case filed by Newsom against the deployment of troops of the National Guard in Los Angeles.
The first lawsuit seeks to fight control over the contingent of the National Guard of California after Newsom claims that Trump illegally surrounded him to unleash the troops.
Judge Brayer, who also deals with this case, ruled in favor of Newsom, but the ninth Court of Appeal ruled in favor of Trump.
